Welcome to Creations by Shelley! The terms “we,” “us,” and “our” refer to Creations by Shelley. We operate this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the “Terms”), together with any policies referenced herein, describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

We do not warrant that the appearance or quality of any product will meet your expectations or be identical to images shown.
All product descriptions are subject to change at any time without notice. We may discontinue products or limit quantities to any person, geographic region, or jurisdiction at our sole discretion.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. We may accept or decline your order at our discretion. Your order is accepted only when we confirm acceptance and process your payment. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after acceptance. If we do not accept, change, or cancel an order, we will attempt to notify you using the e-mail, billing address, and/or phone number provided at checkout.
Your purchases are subject to return or exchange solely in accordance with our [Refund Policy]([Refund Policy URL]).
You represent and warrant that your purchases are for personal or household use, not for commercial resale or export.

SECTION 4 – PRICES AND BILLING

Prices, discounts, and promotions are subject to change without notice. The price charged will be the price in effect at the time the order is placed and shown in your order confirmation. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs, or import charges.
Prices in our online store may differ from prices in physical stores or third-party online stores. Promotions may be governed by separate terms; if there is a conflict, the promotion terms control.
You agree to provide current, complete, and accurate purchase, payment, and account information, and to promptly update it as needed. You represent and warrant that (i) the payment information you provide is true, correct, and complete; (ii) you are authorized to use the payment method; (iii) charges incurred by you will be honored; and (iv) you will pay all charges at the posted prices, including taxes, shipping, and handling.

SECTION 5 – SHIPPING AND DELIVERY

Orders are processed and shipped within 2–4 business days from North Fork, California. Processing time is the time needed to prepare and pack your order before it is handed to the carrier.
Custom or made-to-order items may require additional processing time; any extended timeframe will be discussed with you and confirmed prior to purchase.

Delivery time depends on the method selected at checkout and does not include processing time:

• Economy Shipping (5–8 business days): $4.95 flat rate (free on orders $75+).
• Standard Shipping (3–4 business days): $6.90–$9.90 depending on package weight.

Certain items may ship using different methods or rates (for example, lightweight or specialty products). Any exceptions to the standard options will be clearly stated on the applicable product page.

You will receive a tracking number by e-mail when your order has shipped.

Local pickup: If you are in or around North Fork, please contact us before placing your order to discuss possible pickup arrangements. Pickup is not automatically available through checkout.

We are not liable for shipping or delivery delays. All delivery times are estimates only and are not guaranteed. Once we transfer products to the carrier, title and risk of loss pass to you. However, if your order is significantly delayed or lost in transit, please contact us and we will do our best to assist.

SECTION 6 – INTELLECTUAL PROPERTY

The Services and all content (including trademarks, brands, text, images, graphics, video, audio, and their design and arrangement) are owned by Creations by Shelley, its affiliates, or licensors, and are protected by U.S. and foreign intellectual property laws.
You may use the Services for personal, non-commercial purposes only. Except with our prior written consent, you may not reproduce, distribute, modify, create derivative works of, publicly display or perform, republish, download, store, or transmit any material on the Services. All rights not expressly granted are reserved.
“Creations by Shelley” names, logos, product and service names, designs, and slogans are trademarks of Creations by Shelley or its affiliates/licensors. You may not use such trademarks without prior written permission. “Shopify” and related marks are trademarks of Shopify. Other names and logos are the trademarks of their respective owners.

SECTION 7 – OPTIONAL TOOLS

We may provide access to third-party tools we neither control nor monitor. You acknowledge and agree that such tools are provided “as is” and “as available” without warranties or endorsements, and we are not liable for your use of them. Your use is entirely at your own risk and subject to the third party’s terms. New features offered through the Services will also be subject to these Terms.

SECTION 8 – THIRD-PARTY LINKS

The Services may contain materials or links to third-party websites. We are not responsible for examining or evaluating third-party content or accuracy. Accessing third-party materials or sites is at your own risk. We are not liable for harm or damages related to your use of third-party sites or purchases made there. Review third-party policies carefully before engaging in transactions. Direct complaints or questions about third-party products or services to the third party.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Our store is powered by Shopify. However, any sales and purchases you make are with Creations by Shelley directly. By using the Services, you acknowledge that Shopify is not responsible for any aspect of sales between you and Creations by Shelley, including any injury, damage, or loss resulting from purchased products or services. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Creations by Shelley.

SECTION 10 – PRIVACY POLICY

We may suspend, disable, or terminate your account at any time if we determine you have violated these Terms.

We may terminate these Terms or your access to the Services, in whole or in part, at any time in our sole discretion without notice. You remain liable for all amounts due up to and including the date of termination. Sections that by their nature should survive (including Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver; Entire Agreement, Assignment, Governing Law, and Privacy Policy) will survive termination.

SECTION 15 – DISCLAIMER OF WARRANTIES

The information presented on or through the Services is made available for general information only. We do not warrant the accuracy, completeness, or usefulness of this information. Your reliance is at your own risk.
EXCEPT AS EXPRESSLY STATED BY CREATIONS BY SHELLEY, THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow certain disclaimers; the foregoing may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO CASE SHALL CREATIONS BY SHELLEY OR OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS—OR SHOPIFY AND ITS AFFILIATES—BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR SIMILAR DAMAGES (INCLUDING LOST PROFITS, REVENUE, SAVINGS, DATA, OR REPLACEMENT COSTS) ARISING FROM YOUR USE OF THE SERVICES OR PRODUCTS, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

You agree to indemnify, defend, and hold harmless Creations by Shelley, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, claims, and expenses (including reasonable attorneys’ fees) arising out of or related to (1) your breach of these Terms or referenced documents; (2) your violation of any law or third-party rights; or (3) your access to or use of the Services. We will notify you of any indemnifiable claim (a delay will not relieve your obligations unless materially prejudicial). We may control the defense and settlement at your expense (we won’t agree to non-monetary obligations for you without your consent). You will cooperate in the defense.

If any provision of these Terms is unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permitted, and the unenforceable portion will be deemed severed. The remainder remains in full force and effect.

SECTION 19 – WAIVER; ENTIRE AGREEMENT

Our failure to exercise or enforce any right or provision shall not constitute a waiver. These Terms and any policies or operating rules posted on the Services constitute the entire agreement between you and us and supersede prior or contemporaneous agreements, communications, and proposals. These Terms and any separate agreements under which we provide Services are governed by the laws of the State of California, without regard to conflict-of-law principles. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the state and federal courts located in Madera County, California, and you and Creations by Shelley consent to personal jurisdiction and venue in those courts.
